THE PROCESS - HOW TO HIRE TEMPORARY FOREIGN WORKERS |
Some categories of employment do not require LMOs pursuant to international agreements, such as the North American Free Trade Agreement or the General Agreement on Trade in Services, and government policy.
To hire a foreign worker, an employer must obtain a positive Labour Market Opinion (LMO), also known as an employment confirmation from Service Canada through Human Resources and Social Development Canada (HRSDC). A positive LMO is required before your prospective foreign worker(s) can apply for a work permit.
When applying for an LMO, an Employer will have to demonstrate the following:
- efforts made to hire and/or train willing and available Canadians/permanent residents (e.g. newspaper advertisement, posting on Canada Job Bank website, etc.);
- wages offered are consistent with the prevailing wage rate paid to Canadians in the same occupation in the region;
- working conditions for the occupation meet the current provincial labour market standards;
- any potential benefits that hiring of a foreign worker may have on the Canadian labour market, such as, creation of new jobs, transfer of skills and knowledge.
EXPEDITED LABOUR MARKET OPINION (E-LMO) APPLICATION
To meet the immediate needs of employers, a new pilot project, E-LMO (Expedited Labour Market Opinion) has been implemented by the Government of Canada for positions located in Alberta and British Columbia to expedite the approval process to hire temporary foreign workers. Employers must qualify to participate in this pilot project.
Approval process is within one week.
E-LMO is specific for the following occupations:

A positive LMO (whether through regular LMO or E-LMO process) is required in order for the prospective worker to process a work permit application in his/her homeland.
